About Those Pictures...

Before anyone goes and wastes any money on an attorney trying to sue me for posting pictures here please read before you comment that I can either remove them the easy way or the hard way, it just makes you look like an idiot.

This Statement of Rights and Responsibilities (Statement) derives from the
Facebook Principles, and governs our relationship with users and others who interact with Facebook. By using or accessing Facebook, you agree to this Statement.
  1. Privacy

Your privacy is very important to us. We designed our
Privacy Policy to make important disclosures about how you can use Facebook to share with others and how we collect and can use your content and information. We encourage you to read the Privacy Policy, and to use it to help make informed decisions.
  2. Sharing Your Content and Information
You own all of the content and information you post on Facebook, and you can control how it is shared through your
privacy and application settings. In addition:
    1. For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Facebook (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
    2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
    3. When you use an application, your content and information is shared with the application. We require applications to respect your privacy, and your agreement with that application will control how the application can use, store, and transfer that content and information. (To learn more about Platform, read our Privacy Policy and Platform Page.)
    4. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of Facebook, to access and use that information, and to associate it with you (i.e., your name and profile picture).
    5. We always appreciate your feedback or other suggestions about Facebook, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).
The rest of Facebook's Terms and Conditions can be found here. Please do your research before making idle threats.

  1. Elisha or someone shared the photos in a private group and then deleted the pictures from that group. That ended any permission under the Facebook license.

The posting on the pictures here does not come under the Facebook license and is illegal. Essentially, you stole those pictures.

    4. Wrong. the pictures were NOT shared with the public. The pictures were posted in a PRIVATE group. If the pictures had been posted in a public setting it would be different. But they were NOT posted for public viewing. Then they were deleted, i.e. the IP Content was removed.

"This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it."

Elisha or someone else did not SHARE the photos with YOU. You are not a member of TLLOM. The pics were shared with members only in a private setting and then deleted. The fact that YOU stole the pictures gives YOU no rights.

    5. Also, the Facebook license runs to Facebook, not to its members. The fact that Facebook claims a license, does not give YOU a license.

    7. This entire Facebook language is irrelevant. It gives rights to Facebook, not to its members or the general public. This language does not constitute a release of copyrights, only a license to the corporate entity known as Facebook. Unless you work for Facebook, this language gets you nowhere.

  5. Aww. Someone's upset now that they learned their words are worthless when Policy and Terms/Conditions come to play. Watch your mouth, Anonymous...sending comments such as the filth you've posted in the last five minutes warrant legal action. IP addresses can be tracked right to the source of the computer in which bullying activity is posted. Forgot about that one, huh? Hope you're not directly related to this case, or you'll screw yourself into a whole new world of issues here.

And don't think I didn't take a screen shot of your commentary telling this blogger to KILL HERSELF and that you HOPE SHE DIES! That is illegal, and warrants police investigations if "Tori" so wishes to request it.

    5. No, this blog and its writers are simply enjoying their constitutional rights for free speech. The PUBLIC PHOTOS, posted on various websites (including Facebook) gave the public free range to do as they please. Please understand the Law and everything included in the Policies available so that you are aware that "things aren't always what they seem". You think you've got privacy on the internet? Unfortunately, you don't. EVER. You want to post your thoughts, opinions, possible scenarios of current events (because face reality, Ayla's disappearance is a "current event" considering how much national attention its attained)? You can do so, whenever you wish to do so. It's just how it goes...this is reality.

If harassment or cyber-stalking were involved, the blog owner and writers would be directly writing to the DiPietro family; intentionally posting messages to them online wherein they detailed name-calling, WISHES FOR THEM TO DIE AND/OR KILL THEMSELVES (as you other Anonymous posters have done this morning), and things of the like. THIS BLOG comes NOWHERE NEAR THAT.

It's pretty sad, the anon groupies were all impressed with the UN"happy" pics of Ayla, until signs of neglect were obvious and noted. NOW, all of a sudden, they were/are supposed to be "private". They are NOT private.

If someone is unhappy with the PUBLIC release of the neglectful pictures, they should take it up with Selena, Elisha and Courtney.

Also, wanted the pictures to be removed looks GUILTY.

    1. Still does not give anyone any rights to steal the photos and publish them here. The person who took the pictures owns the copyrights and has the right to object to someone publishing the picture without permission. This is stealing.

      Delete
    2. Do you know what it takes for someone to submit documentation for Copyright Registration? This is just a piece of what I do every in my career. First, you have to submit a form PA online, which will then direct to you submit along with the form, the ORIGINALS of what you want copyrighted. Then, upon submission, you have to pay over $200 for EACH item to be registered for copyright. THEN, it takes them anywhere from six weeks to a YEAR to process. Why? Because the Library of Congress are overloaded with submissions from companies Registering films, episodic series on television, songs, trademarks, and things of the likes. Photographs of one's child would probably take even longer, because they have separate processes for any one matter classification. I mean really, do your research before posting such ridiculous comments.

YES, those who photograph images "own" them, but if you're speaking in terms of owning COPYRIGHTS, that is not valid.

      Delete
    3. JMH, you have no clue. Copyrights exist as a matter of statute. By law, when a photograph is taken, copyrights also come into existence. The person who takes the photo is the automatic owner of the copyrights, without the need for registration. Registration gives certain additional rights and procedural advantages, but it does not CREATE the copyrights. You do not need to do anything at all to own copyrights. The ownership of the copyrights arises automatically.

      Delete
    4. So it is clear that the posting of these pictures without the permission of the owner of the photos violates the copyrights and is illegal.

      Delete
    5. Here's the thing, yes, you own copyrights of images you take. That is obvious. Here's the counter to that, though. Once images become of "public domain", it becomes free of copyrights. Because Aunt Selena, or Courtney (or anyone who took the photos and passed them around family members for public sharing), it automatically expired and/or revoked the copyright ownership. Even in her album on Facebook, Selena stated to please use them to get Ayla's name out there (or whatever her choice of wording was, I can't recall at this time). So, she willingly announced that anyone could use these photos. I'm not trying to be argumentative about this, but unfortunately the family members allowed fair use of their personal family photos all on their own. Now, if these photos were privately posted and friends of theirs were passing them around to others, which then did as they pleased with them? That's a whole different ball game. But these specific photographs were willingly shared by Selena, all over the internet this week for the public to do as they pleased.

Here's an excerpt to some of the legal jargon I pulled researching this before I responded: "Public domain images are not copyrighted, and copyright law does not restrict their use in any way."

      Delete
    6. Sorry but you are wrong. Selina was not the owner of the pictures. The owner is the person who took the photograph. Someone else posting your pictures does not relinquish your copyrights. If that were the case, there would be very few copyrights enforceable in this world.

      Delete
  7. They were not ONLY posted on the private TLLOM fb group. Aunt Selena posted a link at MULTIPLE blogs to the pics. The link is STILL accessible. If they were only posted on the PRIVATE group, how could EVERYONE view them?

Get mad at Selena for publicly posting them. Maybe someone can sue her.

Why be so MAD of "happy", "well cared for", pics of Ayla? That doesn't even make sense.

  8. Fence sitter here. I don't see anything wrong with posting the pictures, but I do question the sweeping assumptions being made based on the pictures. It's a double-edged sword. Someone could easily make case for just about anything based on a snapshot. Look at the pic (from a previous blog post) of Ayla in a tiara. In the background we can see Trista on the phone with a baby (her son I assume) in her lap. She isn't holding him with either hand, and the sun is in his eyes. There are all kinds of unfair assumptions that could be made based on that one shot alone. There are others that I won't get into because there is no need. What I'm trying to say is that it may be fair to say that the Dipietro house is a little shabby, a little dirty, potentially unsafe-anything like that. What I don't think is fair is to say that Ayla was miserable, neglected, unwanted, uncared for, unloved, resented, etc. based on a snapshot.

    1. I am NO fan of how the D family has handled this situation from day one, and I beleive LE, someone in that home knows exactly what happened to Ayla.

As to the photos, they were made public when Selena linked them across half the internet, dem's da breaks.

In regards to the photos, I do feel it is a stretch to say a series of snapshots such as the ones being discussed can illustrate that Ayla was neglected, miserable, abused, resented, etc.

Do I think she may have been abused? Yes. Do I think she may have been resented? Yes. Do I think the photos perfectly illustrate my suspicions to be fact? No. Not even close.

To me the photos illustrate that Ayla was living in a cluttered home with many toys and a cousin. The only thing that the photos tell me is that Ayla is wearing a sling or soft cast in none of them. Whether that is because they were taken prior to the broken arm, I do not know, but it troubles me.

      Let me be very clear.

I do not beleive that Trista or anyone on her behalf has anyting to do with Ayla's disappearance. I firmly believe that someone in or close to the D family is directly responsible for Ayla's disappearance.

But these photos, as with all the evidence in this case, can be interpreted a million ways depending on the viewer and the prism of their own life experiences(see the excellent post re perception a while back on this very blog).

    2. Then the attorney would have to sue the person who posted the images Publicly, and then they would have to involve Facebook because it is their official content (see policies above). A lot of money would be involved in that one.

In terms of having the right to free speech, this blog and its content is in no violation. Posting your opinions, based off of public domain content, is not against the law. Why else would, let's say, groups like the Westboro Baptist Church be allowed to do as they please? Wouldn't pass anywhere in a Court of Law.

it is okay to post any photos you find online on your blog. you should attribute credit to the photographer and if possible post a link back to the source.
if you don't know where they came from, caption: unattributed source, you can add on: no ownership implied if you want.
if you post photos with nudity or 'mature' content, they must be hidden from public view, accessible by a clickable link with an "i agree to view mature content and i am over 18" disclaimer check box.
before ANY litigation, the owner of the photos is required to ask you to remove them.
it is common courtesy and considered proper internet etiquette to comply.
speedy compliance with their wishes and pulling down the photos should resolve any disputes.
    i hope that helps! <3

Stuff in the public domain is often ancient or published by the government.

As far as content goes, you also need permission to republish it, but it is okay to take a small excerpt or summary with a linkback, giving credit, without permission.

  26. SEEKING, you have been shown for the lying C$$T you are. Nobody even posts at your site anymore because you were outed for having 2 total posters and 100 self-trolls of yourself. The DIP crew doesn't even want you as you are making them look worse! Especially with your new Ayla post.. You are a dumb Skeezer/Skank/seedswiller.

    1. FULLY AGREE! I dont know what kind of sympathy or forgiveness Seeking TRUTH is looking for, BUT its not going to work (on me anyway). She/He/It, is obviously mentally disturbed. They tried once already to redeem themself with the story of their father. It MAY have worked a little for some, but we all know the saying - fool me once shame on you, fool me twice shame on me. Not happening to me! I hope others dont allow it either, but everyone is entitled to their own opinion...

    2. I'm committed to only responding to "lies" blogs and comments on other forums such as this one, SA, ST w/Shannie & Boo, several Ayla FB wall's, etc.

I refuse to give Angela, Heidi, Elisha, Lance and drunk-on-coffee-brandy-crazy-Aunt Selana any additional attention and traffic and contribute to increasing their comments numbers on the "liars" blog/page.

I hope you will all join me. If you read something there, just copy and paste it elsewhere and respond if you must. They will see it. Make them come to you, on Ayla's turf.

I'll not include a link to the "lies" blog either, as this just serves to drive more traffic to them.

The more time they have to spend making it "look" like they have popular support and traffic, by responding to themselves with phony comments, patting themselves on the back, the less time they have to exploit Ayla's name and torment her heartbroken mother elsewhere.

  27. Seeking Lies is playing a game. Her whole blog was just a form of entertainment for her. She is one twisted person. If everyone just ignores her and her blog, hopefully she will go away. Unfortunately, she will probably latch onto another missing baby case to continue her sick games. Seeking Lies does not care about Ayla, she does not care about the Dipietros, she does not care about the Reynolds, she only cares for herself and the attention and enjoyment she gets from doing this. Really, really sick!

  28. I am only posting on this thread because it the most recent one...it has nothing to do "about those pictures."

First, let me say that I really like this blog...thank you, Justice for Ayla, for creating it!

Personally, I need look no further than Lance and Tim Crews' severed friendship to conclude the Dipshits' guilt. I cannot entertain a single hypothetical scenario in which I would discourage an ex or present friend to search for my missing niece. NOT A SINGLE ONE. Why in the world would a loving uncle discourage his friend from looking for his missing niece? Fear of Crews finding Ayla? Fear of Crews collecting 30K?

As far as I'm concerned, Lance's attitude towards Tim constitutes a tip, and should be investigated as such.

Tim...I think you are one upstanding Waterville citizen. I hope you have shared Lance's objection towards you looking for Ayla with LE, because I deem it as significant and a potential key to solving the puzzle.

    1. Im curious when Lance allegedly told/asked Tim not to search. Was it in the begining of the investigation....first few days.....when police were saying the same thing for fear of disrupting evidence. Im also wondering when they would have talked because as far as I had heard they had not been on speaking terms since some time in June or July. Please post only facts and information that backs them up....ie fb sites or news articles as Im not interested in rumors. Im getting tired of all the rumors going around BOTH sides.

  29. Lance's position hypothetically could be Crews will destroy evidence tromping around BUT if that were the case he would have told Crews that flat out, IMO.

He may see Crews as a friend, know the search is fruitless and feel he can't say so, so says don't search without explanation. That's where I think truth lies.

He could be afraid Crews will find something, but given the police searches, why would he think Crews would be successful where the police aren't? If Crews had ideas of where to search based on Justin's habits and history, for example, he could share those ideas with police whether or not he went out and searched himself.

  30. The family was happy to put the pictures up but when the public noticed the percentage of photos where Ayla appeared distressed or unhappy the family saw that the public was looking closely. Hmmm is there something else there that we may have missed and the family wants them out of the way quickly before someone discoveres yet another clue
